Mesa Tattoo — Website Terms of Service
Effective Date: 8/1/25 Website: upshurtattoo.com (and any other domain Mesa Tattoo operates)
1. Acceptance of Terms
By accessing or using this website, you agree to these Terms of Service. If you don’t agree, don’t use the site. We may update these Terms from time to time (§12) — continued use after a change means you accept the update.
2. What This Site Is
This site provides information about Mesa Tattoo, our artists, and our work, and lets you request consultations and book appointments through our booking system (currently GoHighLevel). It is not a medical resource, and nothing on it constitutes medical advice. Tattooing carries inherent risks — see §7.
3. Eligibility
You must be 18 or older to request a consultation or book a tattoo appointment through this site. This mirrors our in-shop policy (Service Policies page) — Oregon does not allow a parental-consent path for tattooing minors, and we don’t accept one through the website either.
This site is not directed at children under 13, and we do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has submitted information to us, contact us (§13) and we’ll remove it.
4. Bookings, Retainers, and Service Policies
Booking a consultation or appointment through this site means you’ve read and agreed to our Service Policies (retainer amounts, cancellation/rescheduling terms, pricing, age/consent requirements, and refusal-of-service policy) — available at [link to Service Policies page] and incorporated into these Terms by reference. Where these Terms and the Service Policies page conflict on a booking-specific matter, the Service Policies page governs, since it’s the more specific document.
5. Accounts
If the booking system requires you to create an account, you’re responsible for keeping your login credentials secure and for all activity under your account. Tell us right away if you think your account’s been accessed without your permission.
6. Intellectual Property
Ours. The Mesa Tattoo name, logo, brand system, and all website content we created (text, design, layout) are our property. You may not copy, reproduce, or use them without our written permission.
Artists’ own work. Photos of tattoos and designs shown on this site remain the individual artist’s own work — displayed here with that artist’s permission, consistent with our artists’ independent-contractor agreements, under which each artist retains rights to their own designs and portfolio.
What you submit to us. If you submit reference images, design ideas, or other content through a consultation or booking form, you’re granting us a license to use that content for the purpose of providing you the requested service (consultation, design work, scheduling) — not a general license to use it for marketing or any other purpose without asking you first.
7. Disclaimers
Tattooing is a permanent, elective procedure. Results are not guaranteed. Healing, color retention, and final appearance vary by individual and are not something this website or any statement on it promises. Nothing on this site is medical advice; for a medical concern, talk to a healthcare provider, not this website.
This site is provided “as is.” We don’t guarantee it will be uninterrupted, error-free, or secure, though we work to keep it that way.
8. Limitation of Liability
To the fullest extent Oregon law allows, Mesa Tattoo is not liable for indirect, incidental, or consequential damages arising from your use of this site. This doesn’t limit anything that can’t legally be limited and doesn’t affect any separate agreement (like a signed consent form or Independent Contractor Agreement) that governs an actual tattoo service.
9. Indemnification
You agree to indemnify and hold Mesa Tattoo harmless from claims arising out of your misuse of this site or violation of these Terms.
10. Prohibited Uses
Don’t use this site to: violate any law; scrape, harvest, or bulk-collect data from the site; impersonate anyone; upload malicious code; or interfere with the site’s normal operation.
11. Third-Party Services
Booking and payment processing run through GoHighLevel and its payment processor; those services have their own terms and privacy practices, separate from this site’s. We’re not responsible for third-party services’ own policies.
12. Changes to These Terms
We may update these Terms as the business or the law changes. The current version, with its effective date, always governs.
13. Contact
Questions about these Terms can be sent to: info@bettertattooing.com — Mesa Tattoo, On Upshur, 1801 NW Upshur St, Portland, OR 97209.
14. Governing Law and Disputes
These Terms are governed by Oregon law. Any dispute arising from your use of this website is resolved in the state or federal courts located in Washington County, Oregon.
15. Severability
If any part of these Terms is found unenforceable, the rest stays in effect.
